New simplified Australian student visa system has application backlog

The latest changes in Australia's student visa processing is causing delays and a big rise in visa application rejections, The Australian has reported.

The new Simplified Student Visa Framework which aimed at making a complicated student visa process simpler, came into effect on 1 July 2016. However, it is now threatening the $18.5 billion international education sector in Australia.

According to the news report, thousands of overseas students, particularly from China, are caught up in the complexities of the new system, forcing many educational institutions to postpone the course commencement.

Australian Council of Graduate Research's executive officer Fiona Zammitt told the Australian that concerns over the delays have prompted the Chinese Scholarship Council to recommend students seeking postgraduate education in Australia to look for other countries for their study. She said some applicants were waiting for up to nine months to hear the outcome of their visa applications.

English Australia, a body of the colleges running English language colleges has termed the high visa rejections as a crisis.

Brett Blacker, executive director of English Australia said the new system applied the same criteria to very low-risk students from Japan, for example, as to high-risk applications from Nepal or Pakistan.

A Department of Immigration and Border Control spokesman acknowledged changes to the visa system had caused delays in processing of applications.

He said the department aimed to finalise 75 per cent of complete applications within a month.

Under the Simplified Student Visa Framework, visa subclasses were reduced to study in Australia. International students can now apply for a single student visa - subclass 500, regardless of their chosen course of study.

ACT announces updated Skilled Occupation List

ACT occupation list 1 september 2016

The Australian Capital Territory has released its revised Skilled Occupation List for the Skilled Visa program. The ACT Occupation List Identifies the skills that are in demand in Canberra. The list comes into effect on 1 September 2016.

The latest list has included eleven occupations that were not there in the previous list. The newly added occupations include Graphic Designer, Human Resource Advisor, Recruitment Consultant, Multimedia Designer, Web Designer, Mechanical Engineer etc.

Thirteen occupations that were there in the earlier version of the list but have been dropped in the review are Sales and Marketing Manager, Advertising Manager, Public Relations Manager, Engineering Manager, Cafe or Restaurant Manager (Excluding fast food), Financial Investment Adviser, Financial Investment Manager, Policy Analyst, Management Consultant, Organisation and Methods Analyst, Solicitor, Enrolled Nurse and Mothercarft Nurse.

Eligible applicants can apply for the state nomination if their occupations are open on the Skilled Occupation List.

If you are living in Canberra and your occupation is 'closed' on the SOL, you may still be eligible to apply for state nomination if you are working in a Skilled occupation and meet the nomination criteria.

Overseas residents who have their occupation closed may be able to apply if they have close ties (family or a job offer) in Canberra and meet the nomination criteria.

How to be 'Genuine'? DIBP tightens 457 Nomination Policy - How it affects you?

DIBP tightens 457 visa nomination policy

On 1 July 2016 the Department of Immigration and Border Protection released new policy regarding Subclass 457 visa nominations. A key and arguably the most relevant aspect of a 457 nomination is how 'genuine' the position is. In a move to combat a growing trend of companies taking advantage of the 457 visa the DIBP has overhauled and expanded on what they believe is genuine.

"To avoid doubt, the requirement is not that the position itself must be genuine or 'needed', rather it is that the position associated with the nominated occupation must be genuine. That is, the position must exist and also be what it purports to be." – (a long winded way of creating confusion)

To comply with current regulations companies are encouraged to review the proposed positions duties and responsibilities and ensure they match the publicly listed ANZSCO definition and be listed on the SOL or CSOL list.

This is where a migration agent is key to ensure the position description, the applicant's qualifications, the ANZSCO and most importantly, the company’s purpose and structure, come together. Although it may seem fairly straight forward, for example that a hairdresser needs hairdresser's without providing the necessary documents and certifications the DIBP will question the 'genuineness' of the position.

The last thing you want is for the department to refuse a nomination on the grounds of the position not being genuine as this will only create further headaches for you if you attempt to nominate again. Like a fine Italian suit, each position is unique and a 'genuine position' application needs to be tailored to an individual company and their needs.

Need to travel when visa your visa application is in process?

Do you need to travel, but your visa application is still being processed by the immigration department? Don’t panic! We can help you apply for a Bridging visa B (BVB).

A Bridging via B (BVB) is a temporary visa that lets you leave and return to Australia while your application is being processed by the department.

A BVB allows you to leave and return to Australia during a specified period of time while your visa application is being processed.
