457 Visas to be dumped?


The Business Council of Australia has told the Productivity Commission the controversial labour market testing reporting requirements for 457 visas should be dumped, a call backed yesterday by the Australian Mines and Metals Association.

Following Tony Abbott's announcement of his new cabinet yesterday, the issue of 457 visas is expected to fall under the portfolios of employment minister Eric Abetz and immigration and border protection minister Scott Morrison.

The labour market testing requirements were introduced by the Rudd government amid claims of "widespread employer rorting". They will require companies to show they have tried to recruit Australians, and had been trying for four months, to fill a vacancy before nominating a foreign worker for a 457 visa, although there are exemptions.

In a new submission to a Productivity Commission inquiry into labour mobility, the Business Council calls for the rules to be scrapped because it was already costly to relocate overseas workers to Australia.

WA govt to delay $4000 school fees for children of 457 visa holders

PLANS to slug 457 visa holders whose children attend West Australian public schools have been watered down after a backlash over the budget-boosting measure.

The state government announced the $4000 per year charge, to apply next year, in the 2013/14 budget. Today Premier Colin Barnett said the fee would apply from 2015 and only to first children. For subsequent children, the fees would be halved to $2000 per year, Mr Barnett said.

Client Update: Expanded investment criteria for Significant Investment Visas

Effective from 23 November 2013, the categories of managed funds, regulated by the Australian Securities and Investments Commission (ASIC) which qualify as a 'complying investment' for the purposes of the Business Innovation and Investment (Provisional) (subclass 188) visa and the Business Innovation and Investment (Permanent) (subclass 888) visa (Significant Investor Visa or SIV), will be significantly expanded.


Significant Investment Visas

In order to qualify for a SIV, individuals must:

  • submit an application and be nominated by a State or Territory government;
  • make an investment of at least five million Australian dollars into complying investments; and
  • if granted a provisional visa (subclass 188), the individual must reside in Australia for a period of 160 days over four years in order to qualify for a permanent visa (subclass 888).

Reminder: Visa Fees will increase in December

The DIAC has announced further visa application fee increases for this month following the Government's Economic Statement for 2013-2014.

On the 1st of July 2013, the visa application fees have already been increased for most of the visa and some further increases are to be expected after the end of the year.

If you want to avoid to be hit by a new fees hike, it may be beneficial to get ready for your visa application as soon as possible.
