Skilling Australians Fund Commences on 12 August

From 12 August 2018 employers wishing to nominate skilled overseas workers will need to make a contribution to the Skilling Australia Fund (SAF). The amount your business needs to pay depends on the type of visa and the annual turnover of the sponsoring business.

Businesses nominating a skilled worker for a Subclass 482 Temporary Skills Shortage visa (this includes businesses submitting a nomination application to transfer an existing 457 visa holder) will need to pay:

  • $1,200 per year if the annual turnover of the business is less than $10,000,000
  • $1,800 per year if the annual turnover is higher than $10,000,000.

Businesses nominating a skilled worker for permanent residence under either the Subclass 186 Employer nomination Scheme or the Subclass 187 Regional Sponsored Migration Scheme will need to pay:

  • $3,000 if the annual turnover of the business is less than $10,000,000
  • $5,000 if the annual turnover is higher than $10,000,000.

The SAF charges are payable at the time the nomination application is lodged and for the Subclass 482 TSS visa, is paid upfront for each year your business wishes to nominate an overseas worker. For example, if your business wants to nominate a worker for 4 years under the TSS visa, you need to pay the levy for each of those four years at the time of lodging the nomination application. That's $4,800 for businesses with a turnover of less than $10 million and $7,200 for businesses with a turnover greater than $10 million.

Labour Market Testing

On 12 August 2018 the requirements for labour market testing are also changing requiring employers advertise the position for a minimum of 28 days before submitting a nomination application.

Where labour market testing is necessary, be aware that if the employment contract for the overseas worker is dated before the date your labour market testing completes, the application will be refused.

New Occupations added to the State Lists for Tasmania and South Australia

Tasmania new occupations

South Australia as well as Tasmania Government revised the skilled occupations list over the weekend with Tasmania and South Australia publishing their revised lists earlier today.

South Australia:

South Australia specifically highlighted occupations which are now seen as classed as "low availability" including:

  • 139914 - Quality Assurance Manager
  • 263113 - Network Analyst
  • 411713 - Family Support Worker

In addition, 29 occupations were shifted to supplementary list where special conditions include. Examples of such occupations include:

  • 612115 - Real Estate Representative
  • 313113 - Web Administrator
  • 312511 - Mechanical Engineering Draftsperson
  • 312511 - Mechanical Engineering Draftsperson

South Australia continues to operate using two lists. A supplementary skilled list contains 297 occupations which are those that have not identified as being in shortage; they are available to limited applicants who can demonstrate employment outcomes or family links to support human capital and economic objectives of South Australia's participation in the skilled migrant program. The list is available to international graduates of South Australia; skilled migrants who are working in a skilled occupation in South Australia (minimum time periods apply); have immediate family members permanently residing in South Australia who can support their settlement whilst seeking employment; or who demonstrate strong employability qualities (based on scoring very highly on the Department of Home Affairs Points Test).

Tasmania

The Tasmanian government has committed to process nomination for subclass 489/190 visas for no fee. In addition, the government confirmed there will be no nomination ceilings applicable to state nominations received from 1 July 2018 and that students with no employment offers will be able to access the Tasmanian Skilled Occupations lists which had further occupations added on 6 August 2018 including:

  • 131112 - Sales and Marketing Manager
  • 252712 - Speech Pathologist

Successful applicants who receive a nomination from Tasmanian government will receive an additional 10 points for applying for a subclass 489 visa or five points when making an application for a subclass 190 visa. The usual processing time for Tasmanian government to issue a nomination is two to eight weeks.

 

Five foreign fighters lose Australian citizenship

A total of six individuals have now ceased to be Australian under changes to the Australian Citizenship Act in 2015 to strip dual nationals of Australian citizenship for actions contrary to their allegiance to Australia.

Under section 35 of the Act, a dual national's Australian citizenship automatically ceases if they act contrary to their allegiance to Australia by engaging in terrorism-related conduct. This includes those who fight for or who are in the service of a declared terrorist organisation overseas.

Mobile boarding passes for international flights departing Australia from today

International travellers departing Australia will now be able to check into their flights on their phones.

From 6th August 2018, airlines will be able to issue electronic boarding passes for international flights. Travellers will now be able to show their boarding pass on a mobile device instead of using a paper boarding pass, while following the normal border clearance path at the airport.

The Australian Government leads the way on seamless travel. The Minister for Citizenship and Multicultural Affairs Alan Tudge said the move towards automation at the border was a key focus for the Government.

"Last financial year more than 21.4 million travellers were cleared through the border departing Australian international airports. This number will continue to rise," Mr Tudge said.

"These increasing volumes mean we are always looking for ways to clear legitimate travellers efficiently and seek out those of interest to law enforcement."

"This change will cut out the need to visit the check-in desk to show your passport and collect your paper boarding pass."
