Summary of 17 January 2018 changes to the lists of eligible skilled occupations

Australia has announced changes to the skilled occupation lists for the immigration intake program for the year 2018. The changes take effect on Wednesday, 17th January 2018.

Every year hundreds of thousands of foreign workers choose to live and work in Australia because of the lifestyle and employment opportunities offered.

The Skilled Occupation List (SOL) is a list of skilled occupations that deliver high value skills needed by the Australian economy.

SOL aims to meet medium-to-long-term skill needs of high value occupations, rather than immediate short-term shortages.

There are changes (including additions) to certain occupational caveats (indicated via '*** asterisks') which exclude the use of the occupation in certain circumstances.

These changes will only impact applications lodged on or after 17 January 2018. Applications lodged before this date will not be impacted.

Occupations added to the lists

The three occupations below, which were previously unavailable on either list, have been added to the STSOL. Details of any caveats applicable to these three occupations are also provided:

Occupations moved between the lists

The two occupations below have been moved from the STSOL to the MTLSSL. Details of any caveats applicable to these occupations are also provided.

No occupations have been moved from the MLTSSL to the STSOL.

Occupations removed from the lists

The two occupations listed below have been completely removed from the lists of eligible skilled occupations for all skilled visa programs on 17 January 2018.

Australian Taxation Office to audit visa holders, international students and migration agents

The Australian Taxation Office will begin an audit of visa holders, international students who work in Australia and migration agents who help people migrate to Australia, The Courier Mail reports.

Personal records of over 20 million migrants who have lived in Australia on a visa will be audited over the next three years to check if they have paid their tax and enforce superannuation requirements.

The audit plan also includes auditing migration agents to help identify potential fraudsters rorting foreign investment rules, the report states.

The audit will include the address history of visa applicants and their sponsors; all their arrivals and departures in Australia and details of their education provider if they are on a student visa.

Eligible migrants who left Australia without claiming their superannuation may receive their superannuation amount now.

The ATO said, "It is estimated that records of 20 million individuals will be obtained over the course of the three year period."

"These records will be electronically matched with ATO data holdings to identify noncompliance with obligations under taxation and superannuation laws."

"The objectives of this data matching program are to maintain currency of our knowledge of taxation and superannuation risks within the visa holders, visa sponsors and migration agents populations (and) test the accuracy and strengths of our existing risk detection models ... and identify areas for improvement in our models, treatment systems and practices."

Breeding industry welcomes 457 visa changes

Horse breeder

In a big win for the Australian breeding industry, Thoroughbred Breeders Australia (TBA) has welcomed the Federal Government's move to change the classification relating to horse breeders for the purposes of 457 Visas.

The decision has been made to put the 'Horse Breeder' occupation category on the medium and long term strategic skills list (MTSSL), allowing 457 visa-holders to stay in Australia for up to four years and also have a path to permanent residency.

Under previous regulations, horse breeders on 457 visas were required to leave the country after just two years and TBA chief executive Tom Reilly has welcomed the change in policy.

"Access to skilled staff is one of the biggest issues in the Australian Thoroughbred breeding industry and that is why TBA has been closely engaged with the government and Members of Parliament to bring about this key decision," Reilly said.

"The number of staff recruited from overseas to fill these visa positions has been relatively small, but the value of these skilled and experienced staff is enormous.

"They fill key roles such as stallion managers, yearling managers and foal managers and are responsible for horses worth many millions of dollars."

Last year the Federal Government proposed changes to the 457 visa system which would have had an alarming affect on the racing industry given the large number of foreign workers currently employed in stables.

However Racing Australia chief executive Barry O’Farrell was able to negotiate with the Turnbull Government to prevent the proposed changes and ultimately avoid workforce shortages.

Pilot shortage: Australia to relax visa laws to attract foreign flyers

Australia pilot shortage

Foreign pilots will once again be allowed into Australia on working visas to help address a shortage that threatens to ground planes and cancel flights.

The occupations eligible for foreign worker visas were slashed during a government shake-up in April but from next month pilots will once again be granted access after concerns about the national shortage.

The Regional Aviation Association of Australia says the office of the immigration minister, Peter Dutton, has confirmed the change to the organisation, which is now lobbying for a four-year visa period rather than two.
