Update on Machinery of Government changes

The establishment of the Home Affairs Portfolio, including the Department of Home Affairs, is part of the most significant change to Australia's national security and intelligence arrangements in decades.

The Portfolio brings together Australia's federal law enforcement, national and transport security, criminal justice, emergency management, multicultural affairs and immigration and border-related functions and agencies, working together to keep Australia safe.

There are four operational bodies and agencies that have transferred to the Portfolio:

  • Australian Border Force (ABF)
  • Australian Criminal Intelligence Commission (ACIC)
  • Australian Federal Police (AFP)
  • the Australian Transaction Reports and Analysis Centre (AUSTRAC)

The Australian Security Intelligence Organisation (ASIO) will join the Portfolio subject to the passage of legislation in early 2018.

The Department of Home Affairs incorporates the full suite of functions previously undertaken by the Department of Immigration and Border Protection and the following additional functions:

  • National security and law enforcement policy
  • Emergency management, including crisis management and disaster recovery
  • Countering terrorism policy and coordination
  • Cyber security policy and coordination
  • Countering foreign interference
  • Critical infrastructure protection
  • Multicultural affairs
  • Countering violent extremism programs
  • Transport Security

Machinery of Government negotiations in relation to corporate functions and budgets are continuing across affected departments. An interim organisational structure for the Department of Home Affairs is in place while these negotiations are finalised. A new organisational structure which reflects how the work and functions of Home Affairs will be aligned in the future will come into effect in March 2018.

It is expected the Portfolio will be fully established by July 2018, including a new website for the Department of Home Affairs and a separate website for the Australian Border Force.

Changes for visa applicants in same sex relationships

From 9 December 2017, you can apply for a visa as your partner's 'spouse' if you are in a same-sex marriage following the legalisation of same-sex marriage in Australia.

Under the changes, if you are in a same-sex marriage you can apply for a visa as your partner’s ‘spouse’, rather than as their 'de facto partner'.

The changes will apply to Partner visas (subclasses 100, 309, 801 and 820) and to all other visas where you can include your spouse in your application.

You can also apply for a Prospective Marriage visa (subclass 300) if you are in a same-sex relationship and genuinely intend to marry your prospective spouse in Australia.

Check your travel facility expiry

Check your travel facility expiry

If you're a permanent resident planning to travel outside Australia these holidays, be sure to check your travel facility expiry before you go. An Australian permanent resident visa allows you to live in Australia indefinitely, however the travel facility of your visa will only last for a specified period.

You will need a Resident Return Visa (RRV) if the travel facility on your permanent visa has expired or is about to expire and you wish to travel overseas and retain your Australian permanent resident status.

Checking your travel facility on your visa is easy, visit www.border.gov.au/vevo or download the myVevo application through the app store.

You can apply for an RRV in Australia before you leave, or while you are outside Australia - leaving it until the last minute will result in difficulties checking-in at the airport when trying to re-enter Australia.

Applying for an RRV is simple. You can apply online, without providing any documents, if:

  • you are a permanent resident
  • you have lived in Australia for a total of at least two years within the last five years
  • your name and date of birth have not changed since grant of your last visa.

Departing Australia without an RRV may affect your permanent residence requirements for citizenship.
