This visa is used by employers within an Australian region to source for skilled workers that are not located within their region. This is usually the case where a particular region does not have the necessary Australian skilled workers needed. This visa is valid for a period of 5 years. Family members of the skilled workers can be included as Subsequent Entrant in the application  .

 

Streams of subclass 494 visa

There are two streams of subclass 494 visa

  • Employer sponsored Stream (subclass 494)
  • Labour Agreement Stream (subclass 494)

 

Employer sponsored Stream (subclass 494)

This stream of subclass 494 allows employers to sponsor foreign skilled workers to come to a particular Australian region to work and use their skills towards the development of that region. This is used by the employers where the particular Australian region is lacking such a skill in a particular field of work.

 

Labour Agreement Stream (subclass 494)

Once an employer has nominated a particular skilled worker, this subclass 494 visa stream will be used by the worker to come to Australia to live and work for a duration of 5 years. For this stream of visa to be utilized by the skilled worker, the employer must have a labour agreement with the Australian government.

 

Skilled Employer Sponsored Regional (Provisional) visa (subclass 494) – Eligibility Requirement

All interested persons that intend to apply for the subclass 494 visa must meet the following requirements:

  • Nominated by an employer that has approval as a work sponsor in Australia and is operating a registered business in line with the Australian laws.
  • Must have at least 3 years relevant work experience in nominated occupation
  • Have their occupation in the relevant skilled occupation list
  • Have a satisfactory skill assessment for the chosen occupation
  • Must not have attained the age of 45 at the time of making the application
  • Satisfactory completion of all health requirements including chest x-ray, HIV test, and other relevant health tests
  • Must show good command in English language
  • Meet the character requirements by showing and remaining good character.

 

Skilled Employer Sponsored Regional (Provisional) visa (subclass 494) – Application process

 

The application process for the subclass 494 visa can be broken down into six different steps as explained below –

 

Step one – The applicant must submit an expression of interest (EOI) to the Australian Department of Home Affairs. This allows the applicant to duly notify an approved employer about their interest in being nominated.

Step two – Once nominated, the applicant will receive a formal invitation to submit a visa application.

Step three – Upon invitation, the applicant prepares the relevant documents and proceeds with the application within 60 days of the invite.

Step four – Lodgement of the application online.

Step five – Department of Home Affairs reviews and processes the application.

Step six – Once the application is approved, the visa grant notice will be sent to the applicant including the visa grant number, commencement date of the visa as well as visa conditions where applicable.
