It is true that most Australian visas have an age limit of 44 meaning that those who have attained the age of 45 years are not eligible to apply for an Australian visa.

This article provides alternative options that are available to persons of the age of 45 and above. Despite the country’s higher demand for younger migrants, there are still options available for those over the age of 45, particularly if the purpose of stay is for investment or business purposes.

 

Visa Options for Migrants Aged 45 Years and Above

 

  1. Parent Visa

Persons that are 45 years may be eligible for parent visa subclass provided that they have a family member who is an Australian citizen or a an Australian permanent resident and is currently residing in the country.

There are 6 categories of parent visas available to these class of persons and include the following subclasses:

  • Parent Visa – subclass 103 – permanent
  • Contributory Parent visa – subclass 173 – temporary
  • Contributory Parent Visa – subclass 143 – permanent
  • Aged Parent Visa – subclass 804 – permanent
  • Aged Dependent Relative Visa – subclass 838 onshore
  • Aged Dependent Relative Visa – subclass 114 – offshore
  • Contributory Aged Parent Visa – subclass 884 – temporary
  • Contributory Aged Parent Visa – subclass 864 – permanent
  • Sponsored Parent Visa – subclass 870 – temporary

 

  1. Partner Visa

This visa is granted to those in a genuine relationship with an Australian citizen or Australian permanent resident. You must be in a genuine and continuing relationship with your Australian spouse or de facto partner and your age will not influence your eligibility for this visa meaning you can be older than 45 years of age.

 

  1. Distinguished Talent (subclass 858) Visa

This visa is designed for those with an internally recognised record of exceptional and outstanding achievement in a profession, a sport, the arts or academia and research. You must generally be nominated by the peak Australian body of your field and be of benefit to the Australian community either economically, socially, culturally or to raise Australia’s academic, artistic or sports standing internationally.

Regarding age, the applicant must be between 18 and 55 years of age, however, those older than 55 may still be eligible if it can be established that their skill and contribution will be of exceptional benefit to the Australian community.  

 

  1. Temporary Skill Shortage (subclass 482) Visa

This visa is applicable to skilled workers who are willing to work in an Australian sector experiencing a skilled shortage and have a valid nomination from an Australian business sponsor. This visa contains no age restrictions, however, the Permanent Employer Sponsored (subclass 186) visa, the permanent version of this visa, has an age limit of 45 years, meaning it would generally not be possible to transition to the permanent stage of the 482 visa if you originally applied while already 45 years of age or older.

 

  1. Business Innovation and Investment (Provisional) (subclass 188) Visa

This visa is for those who wish to own and manage a business in Australia or conduct business and investment activity. You must generally be under 55 years of age although the nominating State or Territory may waive this requirement if your proposed business or investment contribution will be of exceptional economic benefit to the State or Territory in which you intend to migrate.
