A skilled immigration visa gives people with the appropriate skills the opportunity to migrate to Australia for the purposes of living and working in the country. There are various skilled migration visas available to migrants who may wish to live and work in Australia. The most common skilled migration visas are Skilled Independent Visa Subclass 189 and Skilled Nominated Visa Subclass 190.

 

Skilled Independent Visa Subclass 189

 

Who is eligible for the subclass 189 visa?

There are two streams that fall within the 189 visa subclass: the New Zealand stream; and the points-tested stream.  

 

New Zealand Stream:

The New Zealand stream is entirely separate from the points-tested stream. Importantly, New Zealand citizens who satisfy the minimum residential and income requirements set out below are not required to go through the invitation and expression of interest process that applicants in the points-tested stream must go through.

For New Zealand citizens, the applicant must have lived in Australia for at least the last 5 years prior to lodging their application. They must also prove that they have taken steps towards contributing positively to the growth and development of Australia by having earned at least AUD53,900 in the last four income years prior to submitting an application. The applicant is also required to satisfy the Department’s minimum health requirements.

 

Points-Tested Stream:

The points-tested stream is available for relevant skilled workers who have been invited to permanently live, work and help develop Australia.

For those applying under the points-test stream, they must satisfy certain requirements based on their working experience, English proficiency, age, working capability, occupation as well as other relevant Australian qualification. The Department rarely considers applicants with less than 85 points. The applicant’s occupation will determine the steps he or she would take to obtain a successful migration skills assessment outcome.

 

The subclass 189 visa would apply to workers who meet the following criteria –

  • The skilled worker must received an invitation to apply for the subclass 189 visa
  • The skilled worker must not have exceeded the age of 45
  • The skilled worker must have taken all necessary health test and passed the medical fitness test
  • The skilled worker must ensure that his or her occupation is on the relevant skilled occupation list

 

It is important to note that the subclass 189 visa might be cancelled where it is discovered that the applicant is already married or is in a de facto relationship before moving into Australia and such information was not disclosed to the Australian immigration authorities. Family members can be attached to your subclass 189 visa, so be sure to disclose the details of members of your family members who are intending to migrate with you.

 

How can an application for the subclass 189 (points-tested stream) visa be made?

For an applicant to successfully apply for the subclass 189 visa in the points-tested stream, the following steps must be taken –

Step one – The applicant must first check and confirm that his or her occupation is available on the skilled occupation list

Step two – The applicant must also confirm that he or she has obtained a minimum of 65 points in the point based test

Step three – The applicant must make a submission of expression of interest (EOI) to the Australian Department of Home Affairs via their online system known as SkillSelect

Step four – The Department of immigration will then invite the applicant to formally submit a visa application

Step four – The applicant will need to prepare the relevant documents and thereafter make a visa application within 60 days after receiving the invite.

Who is eligible for the subclass 190 visa?

The subclass 190 visa allows skilled workers to be nominated for the purposes of permanently residing and working in Australia.

 

What are the requirements for eligibility of a subclass 190 visa?

Before any applicant can even go ahead to make any application for the subclass 190 visa, the following criteria must be met –

  • He or she must have submitted an EOI to be nominated by any agency of the state or territory government of Australia
  • The applicant for the subclass 190 visa must have to take a points test based on their working experience, English proficiency, age, working capability, occupation as well as other relevant Australian qualification.
  • The applicant must score at least 65 points for the test.
  • The applicant must have received an invitation to apply for the subclass 190 visa.
  • The applicant must not have exceeded the age of 45.
  • The applicant must have taken all necessary health test and passed the medical fitness test.
  • The applicant must ensure that his or her occupation is on the relevant skilled occupation list.
  • The applicant must have a relevant skills assessment
  • The applicant must not be owing the Australian government as at the time of submitting an EOI

 

It is important to note that the subclass 190 visa might be cancelled where it is discovered that the applicant is already married or is in a de facto relationship before moving into Australia and such information was not disclosed to the Australian immigration authorities. Also, upon approval of the visa application, the successful applicant must be in Australia before the date stated in the grant letter.

  • The privilege of sponsoring any of your relatives who are eligible for a permanent residency
  • The skilled worker would have the opportunity to apply for an Australian citizenship provided that he or she is eligible

  • The right to travel out and return back to Australia for a period of 5 years
