Further Support for Family Visa Applicants – Onshore Approvals for Offshore Applications
The Federal Government have introduced several new measures designed to alleviate the impact of Covid-19 on visa holders currently in Australia in the way of alternative pathways and concessions for those affected. Recently, the Morrison Government have announced a temporary concession for Family visa applicants whose application was made offshore to allow the approval of their visa while the applicant is onshore in Australia.
Family Visa Application
The Department of Home Affairs acknowledges that applicants who are in Australia are not able to travel offshore as required for the approval of their visa due to the Covid-19 related border closures. These measures will apply to those who applied for certain Family visas offshore and will allow them to remain onshore in Australia without the need to leave the country to receive the final decision on their pending application.
These changes are intended to take effect in early 2021 and will apply to the following Family visa subclasses:
- Partner (subclass 309) visa
- Prospective Marriage (subclass 300) visa
- Child (subclass 101) visa
- Adoption (subclass 102) visa
- Dependent Child (subclass 445) visa
This temporary concession is in addition to the Government’s decision to double the number of Partner visa places in 2020-2021 and reduce the backlog of applications currently in the queue. Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs, Alan Tudge, has announced that the changes are only temporary and will be reviewed in line with any changes to Australia’s international travel restrictions.
It is not known precisely when these measures will be implemented as the Department is yet to issue an exact commencement date.
