The Subclass 858 visa is for persons in Australia who wish to settle permanently in Australia and who have an internationally recognised record of exceptional and outstanding achievement in an eligible area, or have provided specialised assistance to the Australian Government in matters of security.

 

Distinguished Talent visa (subclass 858) – Eligibility Requirement

All interested persons that intend to apply for the subclass 858 visa must meet the following requirements:

  • Have a distinguished skill that will contribute and have a benefit to the Australian community as the whole nation. The contribution may be economic, social, cultural, or to raise Australia’s academic, artistic or sports standing internationally
  • Be able to find work in your nominated field in Australia, or become independently established in your nominated field in Australia
  • Have an international recognition or award in one of the particular fields and must have gained prominence in that field in the past 2 years.
  • Nominated by an Australian organization recognized internationally, apex Australian body, Australian citizen, permanent resident or eligible New Zealand citizen. The person must meet the satisfactory requirements of a nominator as provided by the law
  • Can be of any age except for persons below 18 and above 55 years who will be subjected to prove that their skill and contribution will be of exceptional benefit to the nation.
  • No need to have any prior visa before applying for the subclass 858. However, for applicants residing in Australia at the time of the application, such person must hold any of the following visas – a substantive visa, Bridging visa A – (subclass 010), Bridging visa B – (subclass 020) or Bridging visa C – (subclass 030).
  • Satisfactory completion of all health requirements including chest x-ray, HIV test, and other relevant health tests
  • Must have Functional English language
  • Meet the character requirements by showing good faith and character.
  • Not be indebted to the Australian government
  • Not have had any previous visa cancelled during a stay in Australia or had a previous application refused.

 

Distinguished Talent visa (subclass 858) – Application process

 

The application process for the subclass 858 visa can be broken down into different steps as explained below –

Step one – The applicant must provide a completed nomination form (Form 1000 Nomination for Distinguished Talent) from any of the eligible nominators that meets the criteria set by the government. This form is submitted alongside all necessary informational documents as requested by the Department of Home Affairs.

Step two – Lodgement of the application online via the Department of Home Affairs portal which includes payment of the necessary application fees and submission of all documents.

Step three – Department of Home Affairs reviews and processes the application.

Step four – Once the application is approved, the visa grant notice will be sent to the applicant including the visa grant number, commencement date of the visa as well as visa conditions where applicable. If the application is rejected, the applicant will also be notified with reasons for the refusal and also where there is a possibility of reconsidering the visa application, the applicant will be notified. The visa application fee is non – refundable.
